In the face of a pressing prisons crisis in England and Wales, the Liberal Democrats’ proposal to develop and expand restorative justice schemes as a viable alternative to short custodial sentences, represents a crucial step towards creating a more humane and effective criminal justice system. As of July 2024, England and Wales prison population stands at 87,453, alarmingly close to the operational capacity of 88,864. This overcrowding is not merely a statistic; it signifies a systemic failure to provide adequate rehabilitation opportunities for offenders. The sobering reality is that around 75% of ex-inmates reoffend within nine years of release, with nearly 40% re-entering the criminal justice system within just the first twelve months. These statistics translate into societal costs exceeding £18 billion annually, money that could be allocated to more effective interventions.

The previous Government’s neglect of our prison system has resulted in overcrowded facilities that are under-resourced and understaffed. Incidents of violence and self-harm within prisons have surged, while attacks on prison staff average 23 per day. In 2023, many English prisons fell below minimum staffing levels, creating a toxic environment that hampers rehabilitation efforts. Furthermore, the backlog in our criminal courts has swelled, exacerbating the issue of remand population, which has risen dramatically to a record high of 16,458 people. Considering these challenges, it is clear that the status quo is insufficient and unsustainable.
